General Terms and Conditions

1. Dream Home Art Union is conducted by the Returned and Services League of Australia (Queensland Branch) ABN 79 902 601 713. The Dream Home Art Union is conducted for the purposes of funding veteran welfare and support in Australia pursuant to State/Territory lottery licencing approvals as identified in the draw-specific Terms and Conditions.

2. For the purposes of these Terms and Conditions:

'Account' means an online account which you register with us or with our authorised sales agent to access our Digital Platform and to purchase tickets in a Draw. An Account can be accessed via the Internet or a mobile application on your device.

'Draw' means each individual draw conducted by us.

'Digital Platform' means our online system, such as our website, mobile application or any other digital technology managed by us or on our behalf, that enables you access to interact with our digital services and manage your data and preferences.

'Bonus Funds' means digital Dream Home Art Union redeemable funds intended for use exclusively within the Digital Platform. Bonus Funds are not cash, have no monetary value, and cannot be withdrawn, transferred, purchased or converted into cash.

'Eligible Person' means an individual who is at least 18 years old and is not:

• a member of our management committee, including our board of directors and executive management; our employee or an employee of our subsidiaries; a person (and their employees and agents) directly engaged in conducting the Draw ("Excluded Person");
• a spouse, de-facto spouse, parent, step-parent, siblings, step-siblings, adopted siblings, children and grandchildren of the Excluded Person;
• a household member of the Excluded Person (that is a person is residing at the same premises as the Excluded Person); or
• a resident of the United States of America, United Kingdom or the European Union (unless you purchased tickets in any Draw prior to 25 May 2018).

'Entry Details' means information you must enter to register an Account with our Digital Platform.

'General Lottery Draw' refers to a Prize Home Draw we conduct each year which is not a Golden Treasure Draw.

'Gift Voucher' is a digital voucher issued by us with a unique code and a stored value that is redeemable through an established Account on the Digital Platform for eligible purchases.

'Gold' means gold bullion.

'Golden Treasure Draw' refers to the Prize Home Draws marketed by us as Golden Treasure Draws.

'Prize Home' refers to a home, apartment, apartment complex or other real estate that is offered as whole or part of the prize.

'Prize Home Draw' means a Draw in which a Prize Home is offered as the whole or part of the prize, including General Lottery Draws and Golden Treasure Draws.

'Terms and Conditions' means these General Terms and Conditions, the Prize Home Draw Terms and Conditions, the VIP Club Terms and Conditions, the VIP Club Weekly Giveaways Draw Terms and Conditions, and the Terms and Conditions relating to any other Draw conducted by us.

'Ticket Book' means tickets allocations sold together at the time of purchase.

'VIP Club' means the Dream Home Art Union VIP Club, the terms and conditions of which are set out in the VIP Club Terms and Conditions.

'VIP Club Member' means a person who is a member of the Dream Home Art Union VIP Club in accordance with the VIP Club Terms and Conditions.

'VIP Club Weekly Giveaways Draw' means a Draw conducted by us in which you may only obtain an entry if you are a VIP Club Member.

'We', 'us' and 'our' means Returned and Services League of Australia (Queensland Branch) ABN 79 902 601 713 trading as Dream Home Art Union.

'You' means a person who enters or seeks to enter a Draw.

3. Additional terms and conditions apply to:

• each Prize Home Draw, 'Prize Home Draw Terms and Conditions' (available at https://dreamhomeartunion.com.au/about/terms-and-conditions/prize-home);
• the Prize Home Home Art Union VIP Club membership, 'VIP Club Terms and Conditions' (available at https://dreamhomeartunion.com.au/about/terms-and-conditions/vip-club);
• 'VIP Club Weekly Giveaways Draw Terms and Conditions' (available at https://dreamhomeartunion.com.au/about/terms-and-conditions/vip-club-weekly-giveaways); and
• any other Draws conducted by us from time to time (available as a link on our website where required).

Conditions of Entry

4. By entering a Draw, you acknowledge and agree that you have read and understood these Terms and Conditions including in relation to eligibility requirements, alternative prize arrangements and that you are responsible for seeking your own independent legal advice prior to taking transfer of any prize.

5. Entry in a Draw is open to Eligible Person(s) only.

6. If you purchase tickets on your and another person(s) behalf, you warrant that each of the persons is an Eligible Person and you have the necessary consent and authority to accept these Terms and Conditions on their behalf.

7. To enter a Draw, an Eligible Person must purchase a Ticket Book in a relevant Draw by logging into an Account registered in their name.

8. Only entries that have been paid for in full will be included in a Draw. Any funds you pay us must be received in our bank account before we will issue a Ticket Book to you. If you cancel or reverse a credit card payment for a Ticket Book before the Draw, we will cancel your ticket.

9. Where you purchase tickets in a Draw, but payment is not received by us prior to close or sell-out of the relevant Draw, we will provide you with a refund.

10. To the extent permitted by law, we will not be liable for any loss or damage whatsoever which is suffered or sustained by you or any other person as a result of the warranties given under clauses 5 and 6 being incorrect.

Accounts

11. To register an Account with us you need to be an individual of at least 18 years old and have a valid email address.

12. You must not create an Account in the name of a legal entity whether incorporated or not, trust or a syndicate.

13. Multiple Accounts whether registered to the same person or not cannot be merged.

14. Entry Details associated with an Account may only be updated or amended by an Account holder, unless we receive a valid consent from the Account holder authorising another person to make the change. We may need to verify your identity or the authority to act before making the requested change.

15. Where an Account is held in more than one name, each Account holder may act on the Account on behalf of all Account Holders. However, if an Account Holder requests to remove a joint Account holder, the Account will be closed.

16. DHAU will finalise the register of draw participants after a draw closes at the time of our choosing but before date of draw. Changes to your Account will not apply to finalised registers used to conduct a draw.

17. These Terms and Conditions may not apply to Accounts established separately with authorised third-party sales agents or ticket resellers listed in clause 62.

Tickets - Prize Home Draws

18. We will issue a Ticket Book to the Account holder name(s) after we receive payment in full for the Ticket Book, regardless of whether received from you or another person.

19. Tickets are numbered consecutively within the licensed ticket range, however tickets within multiple Ticket Books may not be consecutively numbered.

20. The following pricing applies to Ticket Book in the $5 General Lottery Draws:

21. The following pricing applies to Ticket Books in the $10 Golden Treasure Draws:

22. Ticket Books must be purchased in a single transaction.

23. The Bonus Gold prize is an additional incentive prize, which is awarded based on the price of the Ticket Book purchased if it contains the winning ticket. For the avoidance of doubt, where multiple ticket books are purchased, and a winning ticket is drawn from within one of the ticket books, the Bonus Gold prize payable is based on the individual ticket book value that contains the winning ticket and not based on the combined total value of the ticket book purchases.

24. To purchase a Ticket Book in a Draw, you must supply an email and at least one other method of contact for ticket issuance and service messaging.

Gift Vouchers

If you buy a Gift Voucher:

25. You can only purchase a Gift Voucher through an Account. Accounts registered with third-party agents and re-sellers are excluded.

26. Gift Vouchers are not cash, cannot be redeemed for cash, are not reloadable, cannot be transferred between accounts, and cannot be used to purchase other gift vouchers.

27. The minimum Gift Voucher value is $5 and maximum value is $4,999, purchase caps may apply.

28. Gift Vouchers may be sent to the nominated recipient's email immediately after the purchase, or on the future date selected at checkout by you. A confirmation email will be sent to you once the Gift Voucher has been sent. Please inform the recipient that the Gift Voucher has been sent to them.

29. Gift Vouchers are non-refundable for change-of-mind and cannot be cancelled, transferred or reissued once purchased. Please review all details carefully before completing your purchase. Refunds cannot be issued in the event of the wrong gift recipient email address being entered.

If you receive a Gift Voucher:

30. To use the Gift Voucher, follow the instructions in the email you receive to create an Account using the same email address.

31. Once your Account has been activated, the voucher will be applied to your account as "Bonus Funds".

32. By activating your Account you accept and agree to these Terms and Conditions.

33. Bonus Funds originating from a Gift Vouchers expire three (3) years from the date the Gift Voucher email is received by you whether your Account has been created or not. Any unused credit remaining after expiry will be forfeited.

34. Dream Home Art Union is not responsible for lost, stolen, or fraudulent misuse of Gift Vouchers once received by you.

Bonus Funds

35. Bonus Funds can be added to your Account:

• As a prize or gift from Dream Home Art Union or,
• As a Gift Voucher.

36.  Bonus Funds may have an expiry date as stated in your Account and any unused balance will be forfeited on expiry. You can view the balance of your Bonus Funds in “My Funds” section of your Account.

37. Bonus Funds can only be used to purchase Dream Home Art Union products. All transactions using Bonus Funds are final and non-refundable for change of mind.

38. Bonus Funds cannot be withdrawn or redeemed for cash, exchanged for any other form of payment, used to buy a Gift Card or transferred to another Account.

39. Dream Home Art Union may adjust or remove Bonus Funds if it was credited in error, due to a system or administrative fault. Where reasonably practicable, we will notify you of any adjustment before or as soon as possible after making the adjustment.

40. For Bonus Funds without an expiry date, if your Account becomes dormant for a period of 12 months and you do not respond to our attempts to contact you, any unused Bonus Funds may be donated to Returned and Services League of Australia (Queensland Branch) for charitable causes. If you subsequently contact us and request a refund of that amount, we may provide that to you. 

Dream Home Art Union VIP Club

41. If you choose to join the Dream Home Art Union VIP Club, the VIP Club Terms and Conditions will apply.

Payments

42. All purchases through our Digital Platform must be made in Australian dollars. We are not responsible for any currency conversion or associated fees if you are located outside of Australia.

43. We accept the following payment methods:

• Credit Card and Debit Card - Visa, Mastercard and AMEX;
• Direct Debit (refer to https://dreamhomeartunion.com.au/about/terms-and-conditions/direct-debit for the Direct Debit Request Service Agreement);
• PayPal;
• Google Pay;
• Apple Pay.

44. Where you wish to purchase a Ticket Book by direct debit, you must make sure that payment is received by us no less than four (4) Brisbane business days before the closing date of the Draw. The funds must clear before we will issue any tickets to you. If the funds are not received less than four (4) Brisbane business days before the closing date of the Draw; or the funds do not clear before the closing date of the Draw; or the Draw has sold out prior to the funds being received or clearing - we will provide you with a refund.

45. Payments for the purchase of tickets in a Draw are not tax deductible. A Ticket Book issued acts as the payment receipt for the purchase.

Refunds

46. Subject to the Australian Consumer Law, refunds are not available for Ticket Books in a closed Draw or for Gift Vouchers.

47. We may allow refunds for the purchase of Ticket Books in an open Draw in the following circumstances: a) if you contact us and request the tickets to be cancelled; b) if there is a major failure and the Draw is cancelled; c) if we amend the Terms and Conditions after your purchase and you do not accept the amended Terms and Conditions.

48. We may also make a refund if you request a refund in accordance with clause 45 or if your ticket is cancelled for any reason other than when clause 72 applies.

49. Refunds in an open Draw will be issued via the same method in which payment was originally received.

Prizes

50. All prize values are listed in Australian dollars.

51. Images and floor plans are for illustrative purposes only, may not be to scale and some staging accessories and decorative items may not be included in the prize. Any vehicles shown are for illustrative purposes only and are not included in the prize, unless stated otherwise.

52. Prizes cannot be transferred or exchanged, and non-cash prizes are not redeemable for cash. Prize values (excluding Prize Home values) are based on the recommended retail prices at the time of purchase (inclusive of GST).

53. The following conditions apply to Prize Homes:

• Estimated Prize Home rental and property values are based on third-party evaluations and subject to fluctuating market conditions. Market demand statements based on third-party data pertain to the suburb in general and may differ based on property traits. RSL Queensland is not liable for third-party information accuracy.
• We will pay council rates, water and body corporate fees relating to a Prize Home for the first 12 months following the date of the Draw, excluding any water consumption fees, additional government invoked levies, or any special levies initiated by a body corporate. This part of the prize is not transferable if you sell the Prize Home during the first 12 months following the date of the Draw and we will not be liable for any of these expenses which arise after the date of sale.
• We will pay certain other costs, such as security, maintenance, insurance, electricity, gas, telecommunications, internet, and all other costs and expenses associated with the prize property for 30 days following the day of the Draw. After this period, these costs become your sole responsibility.
• If it is necessary for us to incur holding costs associated with securing or maintaining the Prize Home beyond the initial 30 days because of a delay caused by you or something within your control, we reserve the right to claim reimbursement from you for these holding costs.
• You must accept the Prize Home in its "as is, where is" condition, subject to legislative requirements.
• You acknowledge that the Prize Home may be encumbered by easements, restrictive covenants or have ongoing development covenants that may affect the Prize Home or its ongoing use. You agree to accept the Prize Home subject to any such covenant or restriction and to sign any document required in order to give effect to any ongoing responsibilities or covenants.

54. Where the prize includes Gold, it is valued at the price of gold on the date of purchase. The true value of the gold if sold may not be worth the full prize value as purchased on the day of the draw due to the fluctuating spot price on the day of sale.

55. Where the prize includes travel, you will receive a voucher from a travel agency nominated by us in the name of the winner. Travel vouchers are not transferable and cannot be redeemed for cash. Further conditions apply, please refer to our suppliers' terms and conditions where applicable.

56. Where the prize consists of cash or a cash component, the prize will be delivered in Australian dollars and you are responsible for any costs (including bank charges and fees) relating to the delivery of the prize or the cash component, including any fluctuations in the rate of exchange.

Transfer of Prizes

57. It is your responsibility to ensure that you can accept a prize should you win in the Draw, under all applicable laws (including the laws of your country if you are an overseas resident).

58. Where you are unable to legally own or receive the nominated prize, or where we are unable to deliver a prize due to natural disaster, fire, theft, destruction or other circumstances beyond our control (such as legislative restrictions in the State, Territory or jurisdiction in which you reside) as may arise from time to time, we may at our absolute discretion offer you a substitute prize of the same value in Australian Dollars or Gold, subject to any written directions from the relevant regulators.

59. We will only transfer prizes and title in any property to you, if your name is on the winning Ticket Book, subject to the production and verification of valid identification. If there is more than one person listed as the entrant on the ticket, the prize will be transferred to those named persons as joint tenants. Any cost and expenses associated with transfer from the prize winner's name to another person is the sole responsibility of the winner.

60. If you are a foreign resident and you are declared to be the winner of land in Australia, you may be required to obtain relevant approvals from the Australian Government authority before we can transfer the property to you. If such approval is required, you must promptly apply to the relevant authority and obtain requisite approval before the prize can be transferred to you. We may assist in this process but are not obligated to do so. You are responsible for the costs of any application and also for any costs associated with the acquisition of land by a foreign person, other than those costs set out in these Terms and Conditions. If approval is refused or not obtained within a reasonable time frame (having regard to applicable published Foreign Investment Review Board policies and procedures), clause 58 will apply.

Agents and Ticket Reseller

61. We may, from time to time, engage with third party agents or ticket resellers to assist with provisioning the sale of tickets and facilitating entries in a Draw. The following third-party agents and ticket reseller are authorised by us and may receive the following commission for their contributions:

• Adflex Marketing Pty Ltd, ABN: 35620652271 (www.adflexmarketing.com.au, 1800 318 030) - an estimated 0.11% of total gross proceeds of the appeal;
• AIDA For Good Pty Ltd, ACN 121 276 506 (www.aidasales.com, (07) 5656 0404) - an estimated 2.2% of total gross proceeds of the appeal;
• Concentrix Services Pty Ltd, ACN 166 171 991 (www.concentrix.com, 1300 288 808) - an estimated 1.6% of total gross proceeds of the appeal;
• TMS Global Services Pty Ltd ABN 22 089 771 835 (www.ozlotteries.com, 1300 188 911) - an estimated 0.02% of the total gross proceeds of the appeal;
• Affiliated On-line Advertisers - an estimated 2.3% of total gross proceeds of the appeal.

Privacy and Communications

62. By entering in a Draw, you acknowledge and agree that we may contact you in relation to:

• Our campaigns, promotional materials and special offers. You may elect to opt out of marketing communications at any time.
• Regardless of your marketing preferences, we may send you communication that are reasonably necessary to administer your purchase and participation in a Draw. These service-related communications may include, by way of example only, updates to the Terms and Conditions, to deliver tickets purchased, updates to our Privacy Policy and anything else required to fulfil your purchase from us.

63. Where applicable, email will be our preferred method of contact with you. If you win, we may contact you over the phone.

Publicity

64. In order to promote the important charitable work of Dream Home Art Union, a prize winner is expected, but not required, to participate in reasonable promotional activities related to the relevant Draw (such as photographs, recordings or interviews).

65. No personal information (including the winner's name, address, image, likeness or voice) will be used or disclosed for promotional purposes without the winner's express consent.

Disclaimer

66. Terms and Conditions apply to all entries into and/or prizes awarded in a Draw. We reserve the right to change the Terms and Conditions at any time, subject to State/Territory lottery licencing approval, by posting such changes on our website dreamhomeartunion.com.au and may notify you in writing of the changes. If you do not agree to the changes, you may request cancellation and refund of your Ticket Book or VIP Subscription in accordance with these Terms and Conditions.

67. The laws of Queensland apply to the conduct of the Draw and the construction of the Terms and Conditions.

68. All Draws and associated prizes not yet approved by State or Territory licensing authorities are subject to receipt of State/Territory licensing approval, or in the case of Draws and associated prizes already approved, ongoing approval.

Liability

69. To the extent permitted by law, including pursuant to schedule 2 of the Competition and Consumer Act 2010 (Cth), participation in the Draw is at your own risk. We will not be liable to you for any loss (whether direct, indirect, consequential or special), expense, damage (including damage to property), personal injury or death arising from participation in a Draw, except to the extent that such loss is caused by our negligence, breach of statutory duty of wilful misconduct. Any liability which cannot be excluded by law is limited to the minimum liability permitted by law.

70. By accepting the prize or any agreed substitute, you agree:

• That we will not be liable to you for any financial consequences (including but not limited to any taxation liability (such as land tax or transfer duty), rates and/ or levies that may accrue to you, impact upon eligibility for or receipt of any pension, benefit allowance, superannuation or similar entitlement or any additional legal or other fees, including insurances (on or after the transfer of any property) to you as a result of winning a prize;
• That you indemnify and hold us harmless from and against any claim, demand, loss, damage, liability, cost or expense (including legal costs) arising out of or in connection with: a) any claim by a third party relating to the winner’s entitlement to the prize, including any claim that the winner was not the proper or authorised recipient of the prize, or that another person has a competing right, interest or claim to the prize or any part of it; and b) to the extent contributed to by the winner or, where applicable, their guest, any claim for loss (whether direct, indirect, consequential or special), expense, damage (including damage to property), personal injury or death arising from or in connection with the acceptance, use or enjoyment of the prize, whether or not such claim arises from negligence or wilful misconduct.
• That upon our request, you must sign a formal legal document to give effect to the limitation of liability and indemnity above.

Cancellation and Suspension

71. If we reasonably suspect or become aware that your purchase of Ticket Books or your use of Account is associated with fraudulent, dishonest, irregular or illegal activity, including where the circumstances may compromise the integrity of a Draw or where a failure to act would result in a breach of any applicable law, we reserve the right to take one or more of the following actions: a) withhold any payment otherwise payable to you; b) suspend or cancel your Account; c) cancel any affected tickets; and/or d) refuse to issue further tickets.

72. We may suspend or cancel your Ticket Books or Account in compliance with our Responsible Gambling obligations.

73. We reserve the right at our sole discretion to suspend your Account or refuse to sell, supply or limit the number of Ticket Books you may wish to obtain. We are not required to provide any reason for such determination.

74. We reserve the right to disqualify entries in the event of non-compliance with the Terms and Conditions.

75. If for any reason any aspect of a Draw is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Dream Home Art Union, Dream Home Art Union may in its sole discretion cancel, terminate, modify or suspend the Draw and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
